Fishing Permit Application Process and Procedure [mention of more or less than 10 vessel agreements]

Note: In order for any fishing vessel of the three gear types, namely longline, a purse or pole & line, to obtain a fishing permit of license to engage in fishing operation or activities in the FSM Fishery Waters, a fishing access agreement must first be established.

Once a fishing access agreement is in place, a fishing permit application could be filed with the National Oceanic Resource Management Authority. The following provides the detail process and procedures in filing a fishing permit application including some of the pre-requisite regional requirements by the Forum Fisheries Agency and the Tuna Commission

1. The applicant is required to first register the vessel with the Forum Fisheries Agency to be included on the FFA Register (How to register with FFA) and also to have the vessels flag State to register the vessel with the Tuna Commission (How to register with the Tuna Commission)

2. Complete (in English) the appropriate Application Form and sen the Application to the National Oceanic Resource Management Authority via any of the following communication mode: (1) by facsimile at fax # 691-320-2383 or (2) electronically to email address norma@mail.fm or (3) by mail addressed to National Oceanic Resource Management Authority, PO BOX PS122, Palikir, Pohnpei FM 96941.

                 (Note: An INCOMPLETE application will not be accepted)

3. The following must accompany the completed Application Form:

A. Payment of annual Registration Fee of $300 for the first application filed during each annual agreement period

B. Payment of the annual Observer Fee (amount as set forth in the Access Agreement)

C. Payment of the Fishing Permit Fee (amount as set forth in the Fishing Access Agreement)

D. A copy of the payment advice or bank draft for payments made via wire transfer (see Fee Payments for detail payment options and other information)

E. A copy of the vessel’s insurance policy (in English) covering the entire period during which the vessel will be licensed to engage in fishing

F. A copy of the vessel’s FFA Registration Certificate

G. A copy of the vessel’s authorization by its flag State to be able to seek fishing access to other coastal State EEZ or fishery waters

4. Upon receipt of the completed Application Form, the supporting documents and payment of the fees, the National Oceanic Resource Management Authority will review the application and make its decision whether to approve and issue the Fishing Permit of disapprove the application

5. If approved, the Fishing Permit will be issued and sent to the applicant. The applicant is required to place the Original Copy of the Fishing Permit in the wheelhouse of the fishing vessel. IF disapproved, the applicant will be informed of the reasons for disapproval of its application. The applicant may contest the decision. (Note: If the National Oceanic Resource Management Authority does not issue its decision within 30 days, the application is deemed approved)

6. The National Oceanic Resource Management Authority requires the applicant to file its application at least two(2) weeks prior to the desired effective date of the Fishing Permit.
